Beidh eolas chomh maith céanna acu siúd a leanann an suíomh seo ar iliomad iarrachta bhunaíocht na Breataine míchlú a chur ar Pearse, a dhúnmharú a cheilt agus ceart a theaghlach ar cheartas a shéanadh, an ceann is déanaí acu ag teacht díreach ó Hugh Orde, ardchonstábla an RUC-PSNI. 25ú Samhain 1992, sháigh scuad faoi cheilt de chuid an RUC gluaisteán Pearse Jordan. D’éirigh sé as an ghluaisteán agus thuisligh sé trasna an bóthar, agus de réir finnéithe sibhialtacha bhí sé gan airm agus ní dhearna sé aon ghníomh bagrach, ach scaoileadh é trí uaire sa droim i neasraon. Níor eisíodh aon rabhadh. Thug na finnéithe sibhialtacha neamhspleácha fianaise chomh maith gur tugadh íde béil do Pearse, gur cuartaíodh, ciceáladh agus brúdh a aghaidh sa talamh agus é ina luí i mbéal báis ar Bhóthar na bhFál i mBéal Feirste. Gan sásamh ar bith a fháil ó chóras breithiúnais náirithe na Breataine, thug teaghlach Pearse a gcás go Cúirt na hEorpa um Chearta an Duine, a thug ní amháin go raibh rialtas na Breataine ciontach as cearta Pearse a shárú, ach a bhí feanntach ar an ‘imscrúdú’ ar a bhású agus na hionchoisní a lean. Sé bliana déag i ndiaidh do pholasaí caitheamh-le-marú rialtas na Breataine Pearse Jordan a mharú, tá an t-ionchoisne ar a bhás fós fada buí ó bheith críochnaithe. Bhí an chéad mhoill san ionchoisne de bhrí gur cuireadh toirmeasc ar chróinéir na Sé Chondae, John Leckey, tuairiscí Stalker agus Sampson ar pholasaí caitheamh-le-marú an RUC a rochtain. Ar na mallaibh, aisiompaíodh an cinneadh seo agus tugadh rochtain choinníollach ar na tuairiscí do John Leckey. Fagann na ‘coinníollacha’ seo nach bhfuil an fhorbairt seo chomh tábhachtach cinnte agus a d’fhéadfadh sí a bheith. Go tuarúil, coimeádann ard-chonstábla an RUC-PSNI Hugh Orde an ceart cosc a chur ar pé a bhfuil rochtain ag Leckey air, ‘ceart’ a bhfuil sé ag iarraidh leas a bhaint as.
Ag maíomh nach bhfuil dualgas dlí air rochtain ar an chomhad a thabhairt don chróinéir, rinne dlíodóir RUC-PSNI Orde argóint go háiféiseach faoin tauirisc go “insofar as it consists of matters of opinion, comment, assessment, conclusions and recommendations, does not constitute ‘information’.” Níl aon oiliúint dlí de dhíth afách le fáil amach cén dóigh a mbeadh tuairimí, conclúidí agus moltaí an oifigigh shinsirigh imscrúdaithe ar dhúnmhárú Pearse Jordan ina ábhar suime don ionchoisne ar dhúnmhárú Pearse. Níos géire arís nuair a bhí an t-imscrúdú cáinte go trom ag Cúirt na hEorpa um Chearta an Duine. Muise, chuir an dlíodóir thar ceann chlann Jordan in iúl go bhfuil an tuairisc in ainm a bheith: “...an analysis of the evidence and is the cornerstone upon which a decision was taken by the DPP not to prosecute Sergeant A for murdering Pearse Jordan”. “The information contained in this report and the process whereby that decision was arrived at could not be more relevant.” Má dhearbhaíonn gníomh seachas briathar, dearbhaíonn péadóireacht MI5 agus gnímh chalaoiseacha, fhuarchríocha agus dhofreagracha an RUC-PSNI i bhfad níos mó ná glór cogarnach treampánach ‘dispeansáid nua’ miotasach na ‘fírinne’, an ‘cheartais’ agus na ‘póilíneachta freagraí’.
Those following this site will be equally aware of the British establishment’s many attempts to smear Pearse, cover-up his murder and deny his families right to justice, the latest of which directly emanates from Hugh Orde, the chief constable of the RUC-PSNI. On November 25 1992, an undercover RUC squad rammed Pearse Jordan’s car. Having emerged from the car and staggered across the road, Pearse, who according to the civilian witnesses, was unarmed and made no threatening actions, was shot three times in the back at close range. No warnings were issued. The four independent civilian witnesses have also testified that, whilst Pearse lay dying on Belfast’s Falls Road, he was verbally abused, searched, kicked and had his face pushed into the ground. Having found no redress through the disgraced British judicial system, Pearse’s family took their case to the European Court of Human Rights, which not only found the British government guilty of violating Pearse’s human rights, but was also scathing of the ‘investigation’ into his execution and the inquests that followed. Sixteen years after the British government’s shoot-to-kill policy resulted in the death of Pearse Jordan, the inquest into his death is still far from complete. The original delay in the inquest was due to the fact that the Six-County coroner, John Leckey, was prohibited from accessing the Stalker and Sampson reports on the RUC’s shoot-to-kill policy. Recently, this decision was overturned and John Leckey had been granted conditional access to the reports. The ‘conditions’, however, render the development decisively less significant than it may have been. Rather ominously, the RUC-PSNI chief constable Hugh Orde reserves the right to censor what Leckey has access to, which is a ‘right’ he is currently attempting to exercise.
Claiming that he is not legally obliged to grant the coroner access to the file, Orde’s RUC-PSNI solicitor, quite ludicrously argued that the report “insofar as it consists of matters of opinion, comment, assessment, conclusions and recommendations, does not constitute ‘information’.” However, one needs no legal training to ascertain how the opinions, conclusions and recommendations of the senior investigating officer into the murder of Pearse Jordan, may be of some interest to the inquest into Pearse’s murder. More acutely so when the enquiry was heavily criticised by the European Court of Human Rights. Indeed, the solicitor acting for the Jordan family has stated that the report: “…purports to be an analysis of the evidence and is the cornerstone upon which a decision was taken by the DPP not to prosecute Sergeant A for murdering Pearse Jordan”. “The information contained in this report and the process whereby that decision was arrived at could not be more relevant.” If actions speak louder than words then the meddling of MI5 and the callous, unaccountable and underhand actions of the RUC-PSNI are to be heard well above the embarrassingly hushed tones of the mythical ‘new dispensation’ of ‘truth’, ‘justice’ and ‘accountable policing’.
